General Trade Conditions

1. Preamble

1.1 Scope of the general terms and conditions of sale

These general terms and conditions of sale (hereinafter referred to as "GTCS") apply to all purchases made remotely on the www.amalalifestyle.com website (hereinafter referred to as "the Site").

The GCS apply in conjunction with the Privacy Policy, which is applicable to all users of the Site.

The www.amalalifestyle.com website is published by Amala Lifestyle (hereinafter referred to as "Amala Lifestyle"), s.a.r.l. with a share capital of 2,000 euros, registered in the Lille Trade and Companies Register under number 505 029 736, whose registered office is located at Centre d'affaires de l'Horlogerie, 41 avenue de Flandre, 59290 Wasquehal, France.

Amala Lifestyle offers for sale, on its Website, interior and exterior furnishing products as well as home decoration items, clothing and costume jewellery (hereinafter referred to as the "Product(s)"), to the customer (defined below) who wishes to make a distance purchase from amala lifestyle (hereinafter referred to as "the Customer").

The Products are marketed under the "Amala Lifestyle" brand owned by Amala Lifestyle.

The Customer must be a natural person and have the legal capacity to contract and act as a consumer, ie a natural person acting solely for the satisfaction of his personal needs.

By placing a distance order with Amala Lifestyle, the Customer declares that he/she fulfils the conditions set out above and in particular that he/she does not make distance purchases of Products with a view to reselling them on a regular basis or as part of a professional activity.

 1.2 Acceptance of the general terms and conditions of sale

These terms and conditions apply to all purchases of Products made from Amala Lifestyle, to the exclusion of any other terms and conditions of sale. The applicable terms and conditions are those in force on the day the order is placed.

The GTC can be viewed, printed, downloaded from all pages of the Site.

On the Site :

The Customer undertakes to read the GTC carefully before placing any order and accepts the GTC by clicking on the order confirmation button.

Applicable version :

The GTC dated the day of the order, are sent to the Customer in the order confirmation email.

Amala Lifestyle may amend the GTC at any time. In case of change, it will be applied to each order the GTC on the day of the order. The date of last update of the GTC is indicated at the end of the GTC document.

 1.3 Conclusion of the contract

On the Site

The contract of sale between Amala Lifestyle and the Customer, for each purchase of Product(s), will, pursuant to the provisions of the Civil Code, be concluded upon clicking on the "Confirm and Pay" button, by which you will have confirmed your shopping cart after having been able to correct it.

1.4 Archiving the contract

Any contract concluded with the Customer corresponding to an order amounting to more than 150 euros including VAT will be archived by Amala Lifestyle for a period of ten (10) years. To access the archived contracts it has signed, the Customer must send a request to contact@amalaproject.com.

2. Products

In accordance with article L.111-1 of the French Consumer Code, the Customer may, prior to placing an order, acquaint himself/herself with the characteristics of the Products he/she wishes to order.

The Customer is required to refer to the description in each product sheet in order to know the essential characteristics.

Amala Lifestyle takes the greatest care in the presentation and description of the Products, within the limits of technology.

Also, the photographs may differ slightly from reality, depending on the configuration of electronic devices used by the Customer. The photographs therefore have no contractual value.

Only Products that can be added to the Basket are available for sale.

If a Product is out of stock or unavailable, this will be indicated on the product sheet.

  

3. Ordering on the Site

Creating a customer account

In order to place an order on the Site, the Customer can first create a customer account by completing the registration form provided for this purpose (hereinafter the "Account").

When the Account is created, the Customer chooses an identifier and an associated password.

The identifier and password are strictly personal and confidential: the Customer undertakes not to divulge them to a third party or to transfer them. Any order placed using this username and password will be deemed to have been placed by the Customer and will therefore bind the Customer to Amala Lifestyle. It is the Client's responsibility to immediately inform Amala Lifestyle in writing of any use of its username and password made without its knowledge.

At any time, the Customer may change its username and password by using the procedure provided for this purpose on the Site.

The Customer undertakes to ensure that the information provided to Amala Lifestyle when creating the Customer Account and when placing each order is accurate, complete and up to date.

If the Customer has made a typing error in the information communicated to Amala Lifestyle, Amala Lifestyle shall not be liable for any resulting difficulty in fulfilling an order.

When a Customer Account is created, the Customer's personal data is collected as described in Amala Lifestyle's Privacy Policy.

Upon completion of the registration process, Amala Lifestyle will send a message to the email address provided by the Customer confirming the opening of his Account.

The Customer may place orders on the Site using his Account.

Stages of the order

The offers and prices appearing on the Site are valid for as long as they remain visible on the Site, within the limit of available stocks of Products.

The Customer must carefully check all the information provided by him in the order form, before confirming it.

Amala Lifestyle can not be held responsible for errors concerning the information provided by the Customer in the order form.

The ordering procedure on the Site is carried out in the following stages:

- The Customer selects the desired Products and quantities on the Site. They may consult and modify the Products selected in the "My basket" function at any time.

- The Customer identifies themselves by using their login details or, if they are not already registered, by using the registration form (see the section on creating a customer account).

- The Customer validates their basket by clicking on "Continue with my order";

- The Customer is informed of the amount of delivery charges before confirming their order.

- A summary of the contents of the order and its total amount including VAT is presented to the Customer. The Customer chooses their method of payment by clicking on the icon corresponding to their choice. They proceed with payment under the conditions described in the section "Prices and methods of payment".

- The Customer's order is finalised as soon as the payment procedure is completed and the Customer is taken to the page on the Site indicating "Thank you for ordering from Amala Lifestyle".

Upon receipt of this order, Amala Lifestyle performs the checks prior to the validation of the order and in particular the effectiveness of the payment of the order, the quantities ordered.

The order and payment thus verified will be followed by an email confirmation - which materializes the registration by Amala Lifestyle of the order - recalling the content of the order and the delivery time and containing the GTC applicable on the date of the order as an attachment.

Orders bind the Customer to their payment, so they are final only once confirmed by the payment of the price, and where appropriate by the confirmation of the payment centre and the registration of full payment of the order.

The Customer will be informed of the dispatch of the Products by e-mail.

Amala Lifestyle reserves the right not to proceed with the order placed by the Customer in particular:

- In case of order (s) exceeding, by their content or their frequency, the needs of an average consumer and more generally in case of abnormal requests or bad faith of the Customer.

- In case of information from the banking institution in charge by Amala Lifestyle of the management of the payment of the order stating the impossibility of implementing the method of payment chosen for the settlement of the order.

- In the event of a previous dispute with the Customer relating to the payment of an order;

- In the event of an order that does not comply with the GTC;

- And more generally in case of legitimate reason as provided by paragraph 1 article L 121-11 of the Consumer Code.

Amala Lifestyle informs the Customer by e-mail or telephone within a reasonable time.

 

4. Prices and payment terms

 

Prices are expressed in euros and include VAT valid in France.

The prices indicated on the Site's Product sheets do not include delivery charges. The Customer is informed of the delivery charges applicable to his/her order before final validation of his/her order and payment of the price.

For deliveries of Products outside French territory, the provisions of the French General Tax Code relating to VAT shall apply. For deliveries outside the European Union, the Customer must pay any customs duties, VAT or other taxes due on the importation of the Products into the country of the place of delivery.

 

The related formalities are the sole responsibility of the Customer, unless otherwise indicated. The Customer is solely responsible for verifying the possibility of importing the products ordered under the laws of the country of delivery.

Amala Lifestyle obtains its supplies from international suppliers. The Customer is therefore informed that Amala Lifestyle reserves the right to change its prices at any time on its Site. The Customer is invited to check carefully the price of the Product before validating his order.

 

The related formalities are the sole responsibility of the Customer, unless otherwise indicated. The Customer is solely responsible for checking that the products ordered can be imported under the laws of the country of delivery.

The total price inclusive of tax (including delivery costs) invoiced to the Customer is that displayed on the summary page before the Customer pays for the order. This price is recalled on the order confirmation sent by email.

Amala Lifestyle will deliver to the delivery address indicated by the Customer at the time of ordering, without Amala Lifestyle being liable for any error or omission concerning this delivery address.

The link to access the invoice will be sent by email to the Customer upon shipment of the order, he can also find the invoice on his Customer Account. Invoice information cannot be modified once the order has been dispatched.

 - Payment by credit card

After completing your order, at the "Secure payment" stage, the Customer simply clicks on the "Credit card" or "American Express" button, as appropriate.

The transaction is carried out using Amala Lifestyle's partner Stripe's 3DS security system. These systems guarantee the encryption and security of the Customer's bank details. Payment is made on a dedicated and secure space provided by the banking institution.

The Customer must be the holder of the bank card used to pay for the order.

The Customer's account will only be debited for the corresponding amount once (i) the details of the bank card used have been verified and (ii) the debit has been accepted by the bank that issued the bank card.

Failure to debit the sums due will result in refusal of the sale.

The payment card used will be debited when the Products are dispatched, after confirmation from the issuing bank.

5. Availability and delivery

The Customer is informed by Amala Lifestyle of the availability of the Product(s) and delivery times when placing the order.

If despite the diligence of Amala Lifestyle, the Products ordered by the Customer are no longer available, Amala Lifestyle will inform the Customer by e-mail or telephone as soon as possible. In this case, no debit will be made to the Customer's account corresponding to the Products no longer available. If the transfer has already been made, Amala Lifestyle undertakes to reimburse the Customer for the part of the payment corresponding to the unavailable Products.

Any technical impediment to receive the package or packages upon arrival of the carrier to the Customer can not result in either return or refund. It is therefore the Customer's responsibility, before confirming their order, to check that they are able to collect their order from the place indicated when they placed their order. No change of address may be made after the order has been dispatched.

In addition, Amala Lifestyle reserves the right to cancel any order that could not be completed due to economic or technical reasons affecting the manufacturing process. The cancellation of an order commits the company Amala Lifestyle to reimburse in full the sums paid for this order, without the Customer being able to claim any additional compensation.

The Products are delivered to the address indicated on the confirmed order.

Amala Lifestyle undertakes to send the Product ordered in the exact condition as described during the sale and confirmed on the order.

Amala Lifestyle undertakes to package the Product in the best possible way, taking into account the dimensions, weight and size of the Product to be shipped.

The amount of delivery charges depends on the total price of the order and the geographical area of delivery. The cost of delivery is indicated to the Customer when the order is placed, before the basket is validated.

The Customer can track the delivery of his parcel using the tracking number provided in the e-mail confirming the shipment of his order.

Amala Lifestyle undertakes to deliver the order no later than 30 days after sending the email confirming the order. The Customer will be informed if delivery is delayed for reasons beyond the control of Amala Lifestyle.

Failing delivery within the agreed period and in accordance with Article L.216-2 of the Consumer Code, the Customer may require Amala Lifestyle, by registered letter with acknowledgment of receipt to the address of the registered office of Amala Lifestyle or by writing on another durable medium, to perform within a reasonable additional period. Failing delivery by Amala Lifestyle within this reasonable additional period, the Customer may cancel the order by registered letter with acknowledgment of receipt to the address of the registered office of Amala Lifestyle, or by writing on another durable medium.

The order shall be deemed cancelled upon receipt by Amala Lifestyle of the letter or writing informing it of such cancellation unless Amala Lifestyle has performed in the meantime.

Where the order has been cancelled by the Customer, Amala Lifestyle will refund the full amount of the Customer's order within a maximum period of fourteen days in accordance with the provisions of Article L.216-3 of the Consumer Code.

6. Receipt of the parcel

The Customer must check the parcel in the presence of the carrier. This verification is considered to have been carried out once the Customer, or a person authorized by the Customer, has signed the delivery note.

If the parcel has been damaged or opened or the Product packaging is damaged, the Customer must refuse it and note explicit reservations on the delivery slip. The Customer must also notify Amala Lifestyle of the anomalies by telephone or via the contact form available on the Site: https://www.Amala Lifestyle.com/ins-contact-us-1.htm, confirm its reservations and refuse to accept the package.

Upon receipt of the return of the package in its warehouses and after noting the damage, Amala Lifestyle will offer either an exchange of the Product, a voucher or a full refund of the damaged Product.

  

7. Retention of title

The Products remain the property of Amala Lifestyle until the signature by the Customer of the delivery note from the carrier, once the Customer has paid the full price and Amala Lifestyle has been able to verify the effectiveness of the payment by the Customer.

  

8. Right of withdrawal

Article L.221-18 of the Consumer Code provides, as part of distance contracts, a withdrawal period of fourteen (14) days for the consumer from receipt for the goods.

How to exercise the right of withdrawal

The exercise of the right of withdrawal by the Customer does not entail any penalty and does not have to be justified.

However, the Customer is informed that the Product must be returned in its original packaging, in perfect condition, fit for resale, unused and with all accessories. In the event of exercising the right of withdrawal, the Customer must contact customer services at contact@amalaproject.com in order to organise the return of the Product to the following address:

Return shipping costs are the responsibility of the Customer.

The exercise of the right of withdrawal gives rise to a refund of the Customer within fourteen (14) days from the date on which Amala Lifestyle is informed of the Customer's decision to withdraw. In the event that Amala Lifestyle has not, within this fourteen (14) day refund period, recovered the Products or obtained proof of shipment of the Products by the Customer, Amala Lifestyle reserves the right to defer the refund until the date of the first of these events to occur.

The refund to the Customer will be made by the means of payment used at the time of the order, unless otherwise agreed with the Customer as to the means of payment used for the refund of its order.

The refund of the Customer will include the refund of any amount paid, including the cost of shipping the Product.

The Customer returns to Amala Lifestyle the new Product in its original packaging, undamaged, accompanied by any accessories, instructions and documentation. In order to ensure the tracking of the package, the Customer is requested to make its return in the same way and with the same service providers as those chosen by Amala Lifestyle for its shipment.

  

9. Cancelling my order after dispatch

The Customer may not request the cancellation of his/her order if the goods have been picked up by the carrier. The Customer must make use of his right of withdrawal at the time of delivery.

  

10. Guarantees

10.1 Legal guarantees

In order to assert its rights under the legal guarantees, the Customer contacts Amala Lifestyle by one of the means of contact mentioned above.

Amala Lifestyle is liable for defects in conformity of the goods to the contract under the conditions set out in Articles L.217-3 et seq. of the Consumer Code and hidden defects of the thing sold under the conditions set out in Articles 1641 et seq. of the Civil Code.

"The consumer has a period of two years from the date of delivery of the goods in which to invoke the legal guarantee of conformity in the event of a lack of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date of its appearance.

Where the contract for the sale of the goods provides for the supply of digital content or a digital service on a continuous basis for a period of more than two years, the legal guarantee applies to this digital content or digital service throughout the period of supply. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or the digital service and not the date of its appearance.

The legal guarantee of conformity requires the trader, where applicable, to provide any updates necessary to maintain the conformity of the goods.

The legal guarantee of conformity gives the consumer the right to repair or replace the goods within thirty days of his request, free of charge and without any major inconvenience to him.

If the goods are repaired under the legal conformity guarantee, the consumer benefits from a six-month extension of the initial guarantee.

If the consumer asks for the goods to be repaired, but the seller requires them to be replaced, the legal guarantee of conformity is renewed for a period of two years from the date on which the goods are replaced.

The consumer may obtain a reduction in the purchase price by keeping the goods or terminate the contract by obtaining a full refund in exchange for the return of the goods, if :

  1. The trader refuses to repair or replace the goods;

  2. The goods are repaired or replaced after a period of thirty days;

  3. The repair or replacement of the goods causes a major inconvenience for the consumer, in particular where the consumer definitively bears the cost of taking back or removing the non-conforming goods, or if he bears the cost of installing the repaired or replacement goods;

  4. The non-conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity. The consumer is also entitled to a reduction in the price of the goods or to rescission of the contract where the lack of conformity is so serious as to justify immediate reduction in the price or rescission of the contract. In such cases, the consumer is not obliged to ask for the goods to be repaired or replaced beforehand.

  5. The consumer does not have the right to rescind the contract if the lack of conformity is minor.

Any period of immobilisation of the goods with a view to their repair or replacement suspends the warranty which was in force until the delivery of the repaired goods.

The rights mentioned above result from the application of articles L. 217-1 to L. 217-32 of the French Consumer Code.

Any seller who obstructs the implementation of the legal guarantee of conformity in bad faith is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual sales (article L. 241-5 of the French Consumer Code).

Consumers also benefit from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund if the goods are returned.

11. Force majeure

Amala Lifestyle may not be held liable if the performance or delay in performance of any of its obligations arises from an event constituting a case of force majeure within the meaning of Article 1218 of the Civil Code such as, but not limited to, natural disasters, fires, epidemics, pandemics, large-scale social unrest, fait du prince, internal or external strikes, breakdowns, shortages, war, etc..

12. Intellectual property rights

The presentation and content of this Site together constitute a work protected by the laws in force on intellectual property, which Amala Lifestyle owns.

 

13. Copyright

The texts, images, drawings and layout as well as the graphic design of the Site are protected by intellectual property law. It is forbidden to copy, extract, distribute or modify the content of the Website for commercial purposes. Downloading and printing text, images and graphic elements are authorised for private, non-commercial use only. The reproduction of drawings, images, sound documents, video sequences and texts in other electronic or printed publications requires the prior written consent of Amala Lifestyle.

The lack of authorization is punishable by the offense of counterfeiting. Any reproduction, in whole or in part, is systematically subject to the authorisation of Amala Lifestyle.

 

14. Databases

The databases established by Amala Lifestyle are protected by copyright and by articles L. 341-1 et seq. of the French Intellectual Property Code relating to the legal protection of databases.

Unless written permission of Amala Lifestyle, any reproduction, representation, adaptation, translation and / or modification, in part or in whole and any substantial extraction qualitative or quantitative to another website is prohibited and punishable by articles L.343-4 et seq. of the Code of Intellectual Property.

 

15. Personal data

The personal data collected may be processed electronically.

The methods of processing this data are available in the Site's "Data Protection" Policy.

  

16. Disputes

This contract is subject to French law. The choice of applicable law is only valid insofar as it does not deprive the Customer of the protection conferred, where applicable, by the mandatory provisions of the country in which he/she has his/her habitual residence.

The French version of the GCS shall prevail over any other version translated into another language.

In the event of a dispute, the Customer should contact contact@amalalifestyle.com in order to find an amicable solution.

The Customer is informed that he/she may in any event have recourse to conventional mediation in accordance with the provisions of articles L 611-1 et seq. of the French Consumer Code.

In accordance with the rules applicable to mediation, any consumer dispute must be the subject of a written complaint to contact@amalaproject.com prior to any request for mediation.

In addition, in accordance with Article 14 of Regulation (EU) No. 524/2013, the Customer is informed that the European Commission has set up an Online Dispute Resolution platform to facilitate the independent out-of-court settlement of online disputes between consumers and professionals in the European Union. Complaints or disputes will always be received sympathetically, good faith always being presumed in those who take the trouble to explain their situation.

Failing amicable settlement, whatever the origin of the dispute, it will fall within the jurisdiction of the competent French courts, in accordance with the rules of common law.
